Abstract: Il contributo esamina la riforma del sistema di Dublino nel quadro del Nuovo Patto sulla migrazione e l’asilo. In particolare, l’obiettivo è quello di illustrare le modifiche intervenute tenendo conto, da un lato, della loro collocazione più generale nel Nuovo Patto e nel regolamento gestione e, dall’altro degli elementi di continuità e discontinuità col regolamento Dublino III e le precedenti proposte di riforma. Il contributo è strutturato come segue: una prima parte ripercorre l’evoluzione del sistema di Dublino e i suoi aspetti critici. Si inquadra successivamente la riforma nel contesto del Nuovo Patto e del regolamento gestione. Si procede, poi, con l’esame degli elementi della riforma che riteniamo di maggior rilievo. Nello specifico, ci si concentra sulle modifiche ai criteri di attribuzione della competenza, sull’introduzione di obblighi incombenti sul richiedente protezione, sul superamento della nozione di carenze sistemiche e, infine, sul sindacato giurisdizionale avverso il trasferimento.

Abstract: The article examines the reform of the Dublin system within the framework of the New Pact on Migration and Asylum. In particular, the aim is, on the one hand, to collocate the reform in the more general place in the New Pact and in the Management Regulation and, on the other, to illustrate the elements of continuity and discontinuity with the Dublin III Regulation and the previous reform proposals. The contribution is structured as follows: a first part traces the evolution of the Dublin system and its critical aspects. The reform is then framed in the context of the New Pact and the management regulation. It then proceeds with an examination of the elements of the reform that we consider most relevant. In particular, we focus on the changes to the criteria for attributing responsibility, on the introduction of obligations on the applicant for protection, on the notion of systemic deficiencies and, finally, on the judicial remedy against transfer.
